Welcome to Paddle District! We want everyone to enjoy their time on the court while keeping safety, respect, and sportsmanship a priority.
This Liability Waiver, Assumption of Risk and Release ("Waiver") applies to individuals participating in activities at Paddle District, including court bookings, pickleball games, Open Play sessions, coaching, tournaments, and other venue activities (collectively, the "Activities").
For purposes of this Waiver, "Paddle District" refers to the venue and its owners, operators, employees, coaches, contractors, and authorized representatives, collectively referred to as the "Released Parties."
Please read this Waiver carefully before participating. It is governed by applicable laws of the Republic of the Philippines, including the Civil Code of the Philippines and relevant consumer protection laws.
I acknowledge that my participation in the Activities is voluntary.
I confirm that I am physically capable of participating in the Activities to the best of my knowledge and understand that pickleball and other physical activities require movement, coordination, and physical exertion.
Participants under 18 years old must have the involvement and consent of a parent or legal guardian, as required by applicable law and Paddle District's policies. A parent or legal guardian may be required to complete a separate consent form before a minor participates.
I understand that pickleball and other court activities involve inherent risks, even when reasonable safety measures are followed. These risks may include, but are not limited to:
Slips, trips, and falls on the playing surface.
Sprains, strains, fractures, bruises, and other physical injuries.
Collisions with other players, spectators, nets, posts, fences, or equipment.
Injuries caused by paddles, balls, or other sports equipment.
Muscle fatigue, dehydration, heat exhaustion, dizziness, or other conditions associated with physical exertion.
Aggravation of pre-existing injuries or medical conditions.
Accidental injuries arising from the actions of other participants.
Loss of, theft of, or damage to personal belongings.
I understand that these risks may occur during regular play, practice, coaching, or other venue activities.
I voluntarily accept the inherent risks associated with participating in the Activities and agree to exercise reasonable care for my own safety and the safety of others.
I acknowledge that I am responsible for assessing my own physical condition before participating.
I will participate only to the extent that I feel physically able to do so.
I will inform venue staff of any immediate safety concern that may affect my participation.
I will stop playing if I experience pain, dizziness, difficulty breathing, or other symptoms that may indicate a health or safety issue.
I understand that Paddle District staff are not a substitute for medical professionals and that the venue does not provide a medical assessment of every participant.
I will seek medical advice when appropriate before engaging in strenuous physical activity.
In the event of an apparent emergency, I authorize Paddle District staff to contact emergency responders and, where reasonably necessary, assist in arranging emergency medical attention. I understand that medical treatment and transport may involve costs for which I may be responsible, subject to applicable law and the circumstances of the incident.
To the extent permitted by Philippine law, I acknowledge the risks associated with the Activities and agree not to hold the Released Parties liable for injuries, losses, or damages arising from the inherent risks of voluntary participation, except where liability arises from negligence, breach of a legal duty, willful misconduct, or other circumstances for which liability cannot lawfully be excluded or limited.
Nothing in this Waiver is intended to remove or restrict any rights or remedies that cannot be waived under applicable Philippine law.
I agree to act responsibly and respectfully while using Paddle District's facilities.
I will:
Follow posted court rules and reasonable instructions from venue staff.
Respect other players, coaches, staff, and spectators.
Avoid reckless play, dangerous conduct, or behavior that may cause injury to others.
Use the courts and equipment only for their intended purposes.
Report unsafe conditions, damaged equipment, accidents, or injuries to venue staff as soon as possible.
I understand that I may be asked to stop playing or leave the venue if my conduct creates a safety risk or seriously violates venue rules, subject to applicable law.
If I use equipment provided or rented by Paddle District, including paddles, balls, nets, or other sports equipment, I agree to use it properly and responsibly.
I will report any visible damage or defect before using the equipment. I understand that I may be held responsible, to the extent permitted by law, for loss or damage resulting from my intentional misuse, negligent handling, or failure to follow reasonable instructions.
I will not use equipment that appears unsafe or defective.
I understand that I am responsible for safeguarding my personal belongings, including phones, wallets, keys, bags, paddles, and other valuables.
Paddle District encourages all participants to keep their belongings secure and avoid leaving valuables unattended.
To the extent permitted by law, Paddle District is not responsible for loss of or damage to personal belongings caused by circumstances outside its reasonable control. Nothing in this section excludes liability where Paddle District is legally responsible.
Paddle District may take photographs or videos for legitimate purposes, such as documenting venue activities, promoting events, or sharing community updates.
Where identifiable images or recordings are used for promotional or marketing purposes, Paddle District will obtain consent or rely on another lawful basis where permitted by applicable law, as appropriate to the circumstances.
Participation in court activities does not, by itself, constitute blanket consent to use an individual's image or likeness for marketing purposes.
Participants who have concerns about photography or video recording may contact Paddle District through its official communication channels.
Any personal information collected through photographs or recordings will be handled in accordance with applicable privacy laws and Paddle District's Privacy Policy.
I agree to observe reasonable hygiene and safety practices while using the venue.
I will avoid participating when I am experiencing symptoms that may make physical activity unsafe for me or create a reasonable risk of transmitting an infectious illness to others.
I understand that shared sports facilities may involve exposure to communicable illnesses despite reasonable precautions.
I agree to respect any reasonable health and safety measures communicated by Paddle District.
Participants under 18 years old must comply with Paddle District's requirements for parental or guardian consent and supervision.
A parent or legal guardian who authorizes a minor's participation acknowledges that pickleball and other court activities involve physical risks and agrees to take reasonable steps to ensure the minor understands and follows the venue's safety rules.
Parents and guardians are responsible for supervising minors as required by Paddle District's policies and applicable law.
Any release, waiver, or assumption of liability involving a minor will apply only to the extent permitted by Philippine law.
To the extent permitted by applicable law, I may be responsible for losses, damages, or third-party claims arising from my own negligent, reckless, or intentional conduct, or from my material violation of venue rules.
Nothing in this section requires me to indemnify the Released Parties for their own negligence, willful misconduct, or other conduct for which such protection is prohibited by law.
If an accident, injury, or other emergency occurs, I agree to notify Paddle District staff as soon as reasonably possible.
I understand that staff may contact emergency services when necessary. I will cooperate with reasonable safety instructions and emergency procedures.
Paddle District cannot guarantee the availability of immediate medical treatment or emergency response facilities at the venue.
If any provision of this Waiver is found to be invalid or unenforceable under applicable Philippine law, that provision will be limited or treated as severable to the extent necessary, and the remaining provisions will continue in effect where legally permissible.
This Waiver is governed by the laws of the Republic of the Philippines.
If a dispute arises in connection with this Waiver or participation in the Activities, the parties are encouraged to attempt to resolve the matter through good-faith communication.
If the matter cannot be resolved amicably, either party may pursue the remedies available through the appropriate authorities or courts with jurisdiction under applicable law.
By signing or electronically acknowledging this Waiver, I confirm that:
I have read and understood the contents of this Waiver.
I understand that pickleball and other physical activities involve inherent risks.
I voluntarily accept the inherent risks associated with my participation.
I agree to follow Paddle District's Court Rules & Reminders and reasonable safety instructions.
I understand that this Waiver does not remove rights or remedies that cannot legally be waived under Philippine law.
I have had the opportunity to ask questions or seek clarification before agreeing.
I acknowledge that my participation is voluntary and that I agree to the terms of this Waiver to the extent permitted by applicable law.
